In 2013, the New South Wales Government reviewed and amended the Swimming Pools Act 1992 and now requires all swimming pools and spas to be registered.

From 2016, a valid compliance or non-compliance certificate must be issued before the property is sold. A Sydney pool certificate is issued after the swimming pool and/or spa has been inspected by qualified Sydney swimming pool and fence certifiers such as POOL CERTIFY.

These changes are designed to enhance the safety of young children around backyard swimming pools and put a stop to easily preventable drownings, injuries and accidents. Requirements for Sydney Pool and Fence Safety Inspections & Certification

The new law applies to all types of swimming pools and spa pools including in-ground, above-ground, indoor, portable and other vessels that are capable of being filled to a depth of 300mm or more of water. Bathroom spas that are emptied after use are excluded.
