Swimming Pool Non-Compliance In Sydney! How To Avoid Fines
Private pool or spa owners in Sydney have numerous account abilities imposed by the local councils. Being a swimming pool owner, you’re required to offer a safe environment for your family members and visitors as well. You are also required to maintain clean filtered pool water that is not hazardous to swim in.
Pool owners rely on their pool fencing to decrease the danger of drowning incidents. However a number of drowning and near-drowning cases have resulted from defective barriers & being non-compliant with Australian standards. And that swimming pool non-compliance can lead you to heavy penalties for every non compliance.
To avoid legal penalties, you must take the steps listed below:
Pool Fences:
• The height of your pool fence should be at least 1200mm.
• The gap between the base of the fence & the ground shouldn’t be more than 100mm.
• Horizontal rails shouldn’t be no closer than 900mm apart
• Vertical rails should be no greater than 100mm apart
• No climbable item should be there within 300mm for the inside and 900mm from the outside.
Signage:
• There must be CPR sign that’s noticeable to anybody close to the pool.
Doors & Windows:
• No door should offer direct access from the home to the pool area
• Windows which open onto the pool area should be fixed so that they don’t open more than 100mm or they’ve a security screen installed.
Gates:
• The pool gate should open away from the pool
• The gate should self-close & self-latch from all open positions
• The gate latch should be a minimum 1500mm off the ground & 1400mm above the top part of the lower horizontal railings.
Fines For Non-Compliance:
Your local government can check your pool to find out whether or not it meets the pool safety standard. Complaints from neighbours about swimming pool issues are always confidential and must always be investigated by Council no matter how small they may seem. If your pool doesn’t meet the pool safety parameter, the local government can and do issue on-the-spot fines. The main way your pool becomes known to Council is via anonymous complaints.
A pool owner can receive a fine of up to $5,500 for not complying with pool safety standards. On the spot penalty of $550 may also be applied for each non compliance.
How to make your pool compliant & avoid a penalty?
To make your pool compliant & avoid a fine, you can:

Thanks Jo – like everything it’s easier when you know how!
Excellent post. I am facing many of these issues as well..
Thanks for sharing Delila, if you have non compliances that have been identified by a private certifier or council inspector and you have not received step-by-step instructions or assistance in resolving those issues (so as to avoid the risk of receiving a fine) we can assist. Here is a link to a typical report that we issue so that you have all the information you need to comply.https://poolcertify.com.au/our-point-of-difference-detailed-information/ Scroll down to “Our Detailed Report” and then see a Council Report for the same property.
Thanks so much to team at POOL CERTIFY for helping me avoid a fine from Council. I can’t believe that not only is the Council’s report so lacking in useful information, that if I don’t go to someone else like Pool Certify, I am left to work this out myself! I can now see the huge benefits of using a private certifier and thanks so much for your time on site yesterday, it was so worthwhile for me
Thanks Jim, I believe time on site with clients in the most valuable part of the process. We don’t just issue Certificates, we focus on ensuring that you can avoid problems with Council as whilst they provide little information of how to rectify any issue and certainly would not suggest an alternative, they can come down hard when the works are not done in a timely manner. New owners are allowed 90 days to complete the works.
I’ve enjoying the regular posts on your facebook page and I just wanted to let you know how much it has clarified things for me.
Thanks Christine, we post twice a week. Our clients provide a never-ending supply of topics as pool compliance is not widely understood due to the lack of any worthwhile education from the authorities in NSW.
